1. Introductory Provisions

These Terms and Conditions govern the rights and obligations between the operator of the online store (hereinafter the "Seller") and customers (hereinafter the "Buyer") in the sale of physical products (e.g. CDs, artwork and other merchandise) and digital products (e.g. audio files, sheet music in PDF format).

Order processing and Merchant of Record (digital products):

Payments for digital products are processed by our payments partner Stripe through Stripe Managed Payments. For these orders Stripe acts as the Merchant of Record: your payment contract is concluded with Stripe, while the product itself is provided by the Seller named above. The applicable buyer terms are presented directly at checkout. Payments for physical products shipped within the EU are processed by the Seller's payment providers and the Seller is the merchant for those orders.

2. Order and Conclusion of the Contract

  1. An order becomes binding once it is confirmed by the Seller.
  2. The purchase contract is concluded at the moment the Buyer receives the order confirmation at their e-mail address.
  3. The Seller reserves the right to refuse an order if the product is unavailable or if an error occurred in the order.
  4. The Seller further reserves the right to cancel an order for two reasons:
    • System error – for example an incorrectly set price, or a technical or administrative error in the order or pricing settings.
    • Delivery address mismatch between the Buyer's delivery address and the currency and applicable VAT rate in the country of delivery.

3. Payment and Delivery Terms

  1. Payments for digital products are processed by Stripe (Managed Payments), our Merchant of Record. At checkout, Stripe offers available payment methods, which may include credit and debit cards, Apple Pay, Google Pay, Link, and others depending on your location.
  2. Stripe or Link may appear alongside the Seller's name on your card or bank statement.
  3. Physical products are delivered through the Czech Post or a courier service. Digital products are made available for download immediately after payment is received.
  4. The delivery time for physical products is usually 3–7 business days, unless stated otherwise.
  5. The Buyer is obliged to inspect the shipment upon receipt. If the packaging is damaged, we recommend not accepting the shipment and contacting the Seller immediately.

4. Price and Shipping Costs

  1. Product prices are shown on the website. For digital products, Stripe as Merchant of Record calculates, collects, and remits any applicable sales tax or VAT based on your location. Displayed prices are final — any applicable tax is already included and the total is shown at checkout before payment.
  2. Shipping costs for physical products are determined during the order and are paid by the Buyer together with the price of the goods.

5. Withdrawal, Returns and Refunds

5.1 30-day money-back guarantee (digital products)

  1. The Seller voluntarily grants a 30-day money-back guarantee on digital products. If the Buyer is not satisfied with a purchased digital product, they may request a full refund within 30 days of purchase by e-mailing the Seller at info@pavelszabo.cz. No reason needs to be given.
  2. Refunds are executed through Stripe to the original payment method, normally within 14 days of the request. Stripe, as Merchant of Record, may also handle refund and dispute requests directly in accordance with the terms presented at checkout.

5.2 Digital products

  1. Digital products (e.g. audio files, sheet music in PDF format) are made available for download immediately after payment. By completing the purchase, the Buyer expressly requests immediate delivery and acknowledges that, to the extent permitted by law, the statutory right of withdrawal no longer applies once delivery has begun.
  2. The voluntary 30-day money-back guarantee under 5.1 is not affected by this and remains available to the Buyer. If a digital product is faulty, corrupted, or cannot be downloaded, contact the Seller at info@pavelszabo.cz and a working copy or refund will be provided.

5.3 Physical products

  1. The Buyer has the right to withdraw from the contract within 14 days of receiving physical goods, without giving a reason.
  2. Withdrawal must be made in writing to the Seller's e-mail address.
  3. The Buyer is obliged to return the physical goods undamaged, in their original packaging, and at their own expense.
  4. Once the returned goods are received and inspected, the refund of the price of the goods is processed using the original payment method, normally within 14 days.

5.4 Statutory rights of EU/EEA consumers

For consumers in the EU/EEA, withdrawal from the contract is governed by Section 1829 et seq. of the Czech Civil Code. For digital products, under Section 1837(l) of the Czech Civil Code the right of withdrawal does not apply where the Buyer has consented to delivery before the end of the withdrawal period.

6. Complaints and Warranty

  1. The Buyer has the right to file a complaint about faulty physical goods within 24 months of receipt.
  2. If a defect appears within one year of receipt, the goods are presumed to have been defective upon receipt (presumption of defect under Section 2161(2) of the Czech Civil Code).

  4. Complaints must be submitted in writing to the Seller's e-mail address.
  5. The Seller undertakes to handle a complaint within 30 days of receipt.

7. Copyright Protection

  1. All digital products (e.g. audio files, sheet music in PDF format) and physical products (e.g. CDs) are protected by copyright.
  2. The Buyer undertakes to use the products solely for their own personal use and not to distribute them further without the Seller's written consent.
  3. Illegal copying, sharing, or other distribution of purchased products is an infringement of copyright and may be prosecuted in accordance with applicable law.

8. Protection of Personal Data

  1. The Seller processes the Buyer's personal data in accordance with applicable law and for the purpose of fulfilling the order.
  2. Detailed information about the processing of personal data is provided in the separate "Privacy Policy" section.

9. Consumer Reviews

The reviews shown on my website come exclusively from customers who have purchased products from me. I verify them by sending the review form only to the e-mail address provided in the specific customer's order. This ensures that the review comes from a genuine buyer of the given product.

10. Final Provisions

  1. These Terms and Conditions are effective from January 1, 2025, last updated on July 5, 2026.
  2. The Seller reserves the right to amend these Terms and Conditions; the current version will always be published on the online store's website.
  3. The Buyer undertakes to review the current Terms and Conditions before each order.
  4. By submitting an order, the Buyer confirms that they have read and agree to these Terms and Conditions.
